1. Acceptance of Terms
By accessing or using HostMCP.dev ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service.
These Terms form a legally binding agreement between you ("User") and HostMCP Engineering ("Company," "we," "us," or "our"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
HostMCP.dev is an enterprise Model Context Protocol (MCP) enablement platform that allows users to connect data sources (databases, APIs, ERPs, and other systems) to AI agents and assistants via the MCP protocol.
The Service includes: a web-based management dashboard, connector configuration tools, tool mapping interfaces, a testing sandbox, audit logging, and API access. Features available depend on your subscription plan.
3. Accounts & Registration
Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.
Account Security: You must immediately notify us at security@hostmcp.dev of any unauthorized use of your account. We are not liable for any losses arising from unauthorized account access where you failed to notify us promptly.
One Account Per User: Unless explicitly authorised (e.g., Enterprise multi-tenant), you may not create multiple accounts for the same individual or share credentials across multiple individuals.
Age Requirement: You must be at least 18 years old to use the Service.
4. License & Permitted Use
License Grant: Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes.
Open Source: Portions of the Service (Connector SDK, generic connectors, shared contracts) are licensed under the MIT License and available at github.com/hostmcp. Open-source components are governed by their respective open-source licences.
Restrictions: You may not:
• Reverse engineer or attempt to extract source code from the proprietary portions of the Service.
• Sublicense, sell, or resell access to the Service.
• Use the Service to build a competing product.
• Circumvent rate limits, quotas, or access controls.
• Use the Service for any unlawful purpose or in violation of applicable regulations.
5. Acceptable Use Policy
You agree not to use the Service to:
• Transmit any content that is illegal, harmful, defamatory, or infringes third-party rights.
• Introduce malware, viruses, or malicious code.
• Conduct automated scraping or harvesting beyond what the Service explicitly supports.
• Interfere with the Service's infrastructure or other users' access.
• Attempt to access data belonging to other users or organizations.
• Violate any applicable laws, including but not limited to data protection laws (GDPR, DPDP Act, HIPAA, PCI-DSS).
Violation of this policy may result in immediate suspension or termination of your account.
6. Your Data, Connector Metadata & Data Fiduciary Warranties
Ownership: You retain all rights to the connector metadata, tool definitions, and configurations you create on the Platform ("User Data"). We do not claim ownership over User Data.
Data Use: We process User Data only to provide the Service, as described in our Privacy Policy. We do not access, use, or share your connector configurations or tool schemas for any purpose other than operating the Service.
Important: HostMCP.dev stores tool metadata (schemas, definitions, configuration), not raw business data (database records, transaction data, etc.). You are responsible for ensuring that any credentials or configuration information you provide to the Platform does not violate your own data governance policies.
Fiduciary Indemnity & DPDP Compliance: You explicitly warrant and represent that you (and/or your organization) act as the lawful Data Fiduciary or Data Controller for all databases, APIs, schemas, and personal data connected to or accessed via the Service. Prior to exposing any database, API, or system containing personal data to an AI agent via HostMCP, you must have obtained all necessary, explicit, and valid consents from your end-users (Data Principals) in full compliance with India's Digital Personal Data Protection Act 2023 (DPDP Act), GDPR, and other applicable privacy laws. You agree to fully indemnify and hold harmless HostMCP Engineering against any regulatory fines, claims, administrative penalties, or legal fees resulting from your failure to obtain valid consent or comply with your obligations as a Data Fiduciary.
Backup: You are responsible for maintaining your own backups of any critical data. We provide data export tools to facilitate this.
7. Intermediary Status & Safe Harbor (IT Act 2000 Section 79)
Data Intermediary Status: HostMCP.dev functions strictly as a technology platform, data pipeline, and intermediary under Section 79 of India's Information Technology Act, 2000 (and equivalent intermediary liability frameworks in other jurisdictions). HostMCP does not initiate transmissions, select recipients, host independent third-party content, or exercise editorial control over the data payloads transmitted between your connected data sources and AI agents.
Safe Harbor Protection: Pursuant to Section 79 of the IT Act 2000, HostMCP is granted full safe harbor immunity and is legally exempt from any liability, claim, loss, penalty, or administrative action arising from third-party content, data, API payloads, or queries flowing through its infrastructure or tools.
8. AI Agent Execution & Write-Action Waiver
Autonomous AI Execution: The Service facilitates Model Context Protocol (MCP) tool execution by third-party Large Language Models (LLMs) and autonomous AI agents. You acknowledge and accept that AI agents operate non-deterministically and may generate unpredicted, unauthorized, or unintended tool invocations.
Write-Action & Catastrophic Loss Waiver: HostMCP.dev is legally, operationally, and financially exempt from any liability, data loss, database corruption, business interruption, or financial loss caused by AI agent tool execution—including but not limited to catastrophic write operations (such as DROP DATABASE, DELETE, TRUNCATE, UPDATE, automated schema alteration, or unintended API transactions).
Recommended Security Controls: We strongly advise all users to enforce read-only scopes by default on all database connectors and mandate explicit human-in-the-loop confirmation before permitting AI agents to call write tools. HostMCP provides scope limiting and approval policy configurations, but the sole legal and technical responsibility for credential permissions and access governance rests with the User.
9. Payment & Billing
Free Plan: The Community plan is free and subject to usage limits as described on our Pricing page.
Paid Plans: Pro and Enterprise plans are billed in advance on a monthly or annual basis. By subscribing, you authorise us to charge your payment method on the applicable billing cycle.
Taxes: All prices are exclusive of applicable taxes (GST, VAT, etc.). You are responsible for all applicable taxes.
Refunds: We offer a pro-rated refund within 7 days of the start of a billing period if you are not satisfied. After 7 days, no refunds are issued for the current billing period. Annual plan refunds are calculated on a pro-rata monthly basis.
Price Changes: We will provide at least 30 days notice before changing prices. Continued use after the effective date constitutes acceptance of the new pricing.
10. Service Availability & SLA
Best Effort (Community): Community plan is provided on a best-effort basis with no uptime guarantee.
Pro Plan SLA: We target 99.5% monthly uptime. Downtime that reduces availability below this level entitles you to a service credit of 10% of monthly fees per 0.5% shortfall, up to 30% of monthly fees.
Enterprise Plan SLA: 99.9% monthly uptime guarantee. Credits of 25% per 0.1% shortfall below SLA, up to 100% of monthly fees.
Exclusions: SLA credits do not apply to downtime caused by: force majeure events, your own infrastructure or network issues, third-party services outside our control, scheduled maintenance (notified 48h in advance), or security incidents.
11. Intellectual Property
Our IP: The Service, including all proprietary software, user interfaces, documentation, branding, and content, is owned by HostMCP Engineering and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.
Open Source: The Connector SDK and community components are licensed under MIT. See github.com/hostmcp for full license terms.
Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use and incorporate that feedback without restriction or compensation to you.
12. Confidentiality
Each party may disclose confidential information to the other in connection with the Service. Both parties agree to: (i) hold such information in confidence; (ii) not disclose it to third parties without prior written consent; and (iii) use it only to the extent necessary for the purpose of these Terms.
Enterprise customers may request a separate Non-Disclosure Agreement (NDA) at enterprise@hostmcp.dev.
13. Limitation of Liability
Disclaimer: The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement.
Liability Cap: To the fullest extent permitted by law, our total liability to you for any claims arising from these Terms or use of the Service shall not exceed the fees you paid to us in the 12 months preceding the claim.
Exclusion: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, business interruption, or AI agent write-action outcomes (e.g. DROP or DELETE commands), even if advised of the possibility of such damages.
Some jurisdictions do not allow limitation of liability for consequential damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless HostMCP Engineering, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (i) your use of the Service; (ii) violation of these Terms; (iii) infringement of any third-party rights; (iv) your User Data; (v) lack of DPDP-compliant consent from end-users; or (vi) actions or operations executed by AI agents connected to your account.
15. Termination
By You: You may terminate your account at any time from account settings. Upon termination, your right to access the Service ceases immediately. Community plan data is deleted after 30 days; paid plan data after 90 days, unless you request earlier deletion.
By Us: We may suspend or terminate your account immediately for: material breach of these Terms, non-payment, fraudulent activity, or if required by law. We will provide notice where practicable.
Effect of Termination: All licences granted to you terminate. You may export your data during the applicable data retention window via the export tool in Settings.
16. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by the laws of India, without regard to conflict of law principles.
Dispute Resolution: Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Bengaluru, India under the rules of the Indian Council of Arbitration (ICA).
International Users: For Enterprise customers domiciled outside India, the parties may mutually agree to alternative dispute resolution mechanisms and governing law in the Enterprise contract.
Class Action Waiver: To the extent permitted by law, both parties waive the right to participate in class action lawsuits.
17. General Provisions
Entire Agreement: These Terms (together with our Privacy Policy) constitute the entire agreement between you and HostMCP Engineering.
Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any provision shall not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity.
Changes to Terms: We will notify you at least 30 days before making material changes to these Terms. Continued use after the effective date constitutes acceptance.
Contact: For questions about these Terms, contact legal@hostmcp.dev.
